TITLE 1 - Definitions
Accompanying person means any person accompanying the PRM (disabled and mobility impaired persons) during transportation. This person must be an adult, civilly responsible, not responsible for a child under 12 years of age during the planned trip, and capable of providing for the needs of the PRMH in his or her care and of evacuating him or her, if necessary, when the PRMH is not autonomous.
Accredited Agent means a natural or legal person whom Carrier has authorized to represent it in the sale of air transportation on its services or those of another Carrier if such agent is authorized.
"Baggage" means:
- The effects and other personal items accompanying the Passenger during his/her trip. Unless otherwise provided, this term refers to both Checked Baggage and Unchecked Baggage of the Passenger.
- The baggage allowance will be written on your ticket, itinerary receipt, or email.
Ticket means a valid document establishing the right to transportation, possibly supplemented by a Baggage Check for Checked Baggage, or by an equivalent means in intangible form, including electronic form, issued or authorized by the Air Carrier or its Authorized Agent *. It embodies the Contract of Carriage, including the Flight Coupons, incorporating these General Conditions of Carriage.
Baggage Check means the identification stub issued by the Carrier and affixed to the Ticket, relating to the carriage of Checked Baggage.
Carrier Designation Code means the code assigned by IATA, identifying each Carrier member of this organization in two or more alphabetical, numerical or alphanumerical characters and appearing on the Ticket: COMPAGNIE AERIENNE INTER REGIONALE EXPRESS (CAIRE) operating under the trade names AIR ANTILLES and AIR GUYANE
Contract of Carriage means the declarations and stipulations attached to the tickets identified as such and incorporating these General Conditions of Carriage as well as the notices to Passengers where applicable.
Convention means, depending on the case:
- The Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw on October 12, 1929. (referred to above as the Warsaw Convention),
- The Hague Protocol of 28 September 1955, amending the Warsaw Convention,
- The Supplementary Convention of Guadalajara, of September 18, 1961,
- The Montreal Protocols No. 1, 2 and 4 (1975), amending the Warsaw Convention,
- The Montreal Convention of May 29, 1999.
Flight Coupon means the portion of the Ticket identified as "valid for carriage" or, in the case of an Electronic Ticket, the Electronic Coupon indicating the specific points between which the Passenger is to be carried.
Special Declaration of Interest means the Declaration made by the Passenger at the time of delivery of the Baggage to be checked in, specifying a value higher than that fixed as the limit of liability enacted by the Convention, and subject to the payment of an additional sum.
Damage covers death, injury, delay, total or partial loss or other damage arising out of or in connection with air transportation or other services performed by us in connection with air transportation, as defined below.
Special Drawing Right (SDR) means a unit of account of the International Monetary Fund (IMF) whose value is determined periodically by the latter, based on the rate of several reference currencies.
Force Majeure means unusual, unforeseen and irresistible circumstances, the consequences of which could not have been avoided even if all measures had been taken to do so.
Recording Time Limit (RTL) means the time limit, as indicated for each flight, before which the Passenger must have completed check-in formalities and received his/her boarding pass or access card.
Days means the days of the calendar comprising the seven days of the week, provided that in the case of notification, the day of mailing shall not be counted and that for the purpose of determining the period of validity of a Ticket, the day of issue of the Ticket or the day of commencement of the flight shall not be counted.
Passenger means any person, other than crew members, carried or to be carried by air, in possession of a Ticket.
PHMR means any person whose mobility is reduced, when using a means of transport, due to any physical disability (sensory or motor, permanent or temporary) or any intellectual disability or impairment or any other cause of disability, or age, and whose situation requires appropriate attention and adaptation to his or her particular needs of the service made available to all passengers. (Art 2 of the European regulation 1107/2006 of 5 July 2006).
Reservation means the fact that a Passenger is in possession of a Ticket, or other proof, indicating that the Reservation has been accepted and recorded by the Airline or tour operator.
Meaning means a journey u" means all airlines which carry or undertake to carry the passenger or his baggage in performance of the Contract of Carriage or which render any other service in connection with such carriage. In the text, it may therefore refer to the Company in performance of the Contract of Carriage.
A distinction must be made between the contracting Carrier and the actual Carrier.
The Contracting Carrier is the Carrier who issues the Ticket as a party to the contract of carriage (concluded with a passenger, or a person acting on behalf of the passenger), by virtue of which the carriage of the person and his/her luggage will be provided or guaranteed, and who is liable in case of failure or partial performance of the relevant carriage.
The Effective Carrier is any Carrier that, by agreement or authorization of the Contracting Carrier, provides all or part of the actual transportation but is not a Successor Carrier (see) under the applicable regulations.
Community air carrier or Community air carrier means an Air Carrier holding a valid operating license issued by a Member State of the European Union, in accordance with the provisions of Council Regulation (EEC) No. 2407/92 of 23 July 1992.
Code Share "means" a flight operated by an Air Carrier that may be either the Carrier with which the Passenger has contracted (contracting Carrier or contractual Carrier), or another Carrier (Carrier operating the flight or de facto Carrier) to which the contracting Carrier has associated its Designator Code.
TITLE 2 - General and Application
The conditions of the Contract of Carriage are the conditions to which the Passenger's Ticket refers. Subject to the provisions set forth below, these General Conditions of Carriage apply to any flight, or portion of a flight, for which the Company Designator Code appears in the "Carrier" box of the Ticket. These General Conditions of Carriage also apply to carriage free of charge or at a reduced fare, unless otherwise provided for in the Contract of Carriage or in any other contractual document binding the Company to the Passenger.
No agent, servant or representative of Carrier shall have the authority to modify or delete any provision of this Agreement.
All transportation is subject to the Carrier's General Conditions of Carriage and fare regulations in effect at the time of Ticket issuance or, if such date cannot be determined, at the time of commencement of the transportation covered by the first Flight Coupon of the Ticket.
These General Conditions of Carriage are established in application of the Montreal Convention of May 28, 1999 and of the European Community law in force.
These General Conditions of Carriage shall apply insofar as they do not conflict with applicable law or any Tariffs filed, in which case such law or Tariffs shall prevail. The invalidity of one or more provisions of these General Conditions of Carriage shall not affect the validity of the remaining provisions.
TITLE 3 - The Ticket
Use of the Ticket
To be accepted for carriage, any Ticket (including Electronic Ticket) must be used in its entirety and in the sequential order of the coupons, in accordance with the Company's General Conditions of Carriage and unless otherwise agreed by the Carrier.
All Tickets must be paid in full prior to boarding. Otherwise, the beneficiary of said Ticket will be denied boarding. In the event of a problem with the payment of the Ticket, the Company may charge the credit card corresponding to the total amount of the Ticket and the associated fees in order to regularize the payment, even if the Ticket is used in whole or in part.
The carriage service is only provided to the Passenger designated on the Ticket. The Carrier reserves the right to carry out documentary verification of the identity of its Passengers.
If the Passenger wishes to change all or part of his/her journey, he/she must first contact the Carrier. The fare will be recalculated and the Passenger will then have the option of accepting the new fare or maintaining the original carriage, as shown on the Ticket.
Ticket validity period
The Ticket shall be valid for one year from the date of issue unless otherwise provided in the Ticket or in Carrier's applicable fares, conditions of carriage and regulations. The fare for carriage hereunder is subject to change prior to the commencement of carriage. Carrier shall have the right to refuse transportation if the applicable fare has not been paid.
Buy a Ticket
Prices are published inclusive of all taxes, with the exception of certain airport taxes levied locally. Any purchase of an Airline Ticket made on the website www.airantilles.com and/or www.airguyane.com, by telephone from the Company's reservation center or at a direct point of sale (agency or airport counter) implies acceptance by the customer or website user of these General Terms and Conditions of Sale and Carriage and of the special terms and conditions attached to the Ticket(s) chosen.
We draw your attention to the fact that, in accordance with the provisions of Article L121-20- 4 of the Consumer Code, the Internet user does not have a right of withdrawal when purchasing tickets on our site.
TITLE 4 - Personal data :
The Passenger communicates to the Carrier, or to its Authorised Agent, personal data concerning him/her in order to make a Reservation, to obtain additional services, to facilitate immigration formalities and to enter the territory of a State. This personal information communicated to the Carrier in connection with the subscription and performance of the Contract of Carriage may be subject to computer processing. This information is collected and processed in accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended.
The data communicated by the Passenger is mainly used for the purposes of (i) making reservations and purchasing Tickets, (ii) providing specific services in connection with the transportation service, (iii) prospecting, building loyalty, promoting and providing commercial information and (iv) conducting statistical studies. It may also be used to facilitate the completion of administrative formalities relating to immigration and entry into the country, to prevent non-payment and to combat fraud, as well as to ensure the safety and security of flights.
Passengers are informed that any incident occurring during the performance of the Contract of Carriage and likely to affect the safety or security of a flight may be recorded by computer. Passengers are informed and accept that the provision of certain specific ancillary services (special meals, medical assistance) may lead the Carrier to record in its processing information likely to fall within the scope of Article 8 of the amended "Data Protection Act". This information is used exclusively for the specific additional services requested by the Passenger.
The data collected may be communicated to the authorized personnel of the Carrier, its partners (Authorized Agents, Carriers as defined in Article 1 above, etc.) or its ancillary service providers, as part of the fulfillment of all or part of the purposes mentioned above.

It is specified that some of the recipients mentioned above may be established outside the European Union and may have access to all or part of the personal information collected by the Carrier (surname, first name, passport number, travel details, etc.), for the purpose of performing the Passenger's Contract of Carriage or due to a specific legal entitlement. Data transfers outside the European Union are carried out in accordance with the conditions defined in articles 68 et seq. of the French law "Informatique et libertés".
In accordance with the French law on information technology and civil liberties, Passengers have the right to access, rectify, delete or oppose data concerning them. These rights may be exercised by mail to the following address Air Antilles - Correspondant Informatique et Libertés - 17 lot Agat Immeuble Technopolis ZI JARRY 97122 BAIE-MAHAULT.
Subject to the regulations in force, the Carrier reserves the right to use Passenger data under the conditions and for the purposes defined in this article.
Unless the Passenger expresses his/her opposition when his/her data is collected or sent by mail to the above address, the Carrier reserves the right to use the Passenger's data or to communicate it to its partners in order to be able to send him/her appropriate commercial offers.
Where required by law (electronic commercial canvassing), the Passenger's data will only be used for canvassing purposes, in particular commercial canvassing, by the Carrier or its partners if the Passenger has given their consent to such use at the time of communication of their personal data. Passengers may, at a later date, object to their data being used for such purposes, by sending a letter to the above address.
It is specified that the collection of certain personal data is essential to enable the Reservation to be made and to establish the Contract of Carriage. Passengers may naturally exercise their right to object to the collection and processing of such data, but are informed that this may result in the cancellation of the journey or the impossibility of accessing certain specific additional services requested (special meals, etc.). It is also reminded that, in accordance with the laws and regulations applicable in France and internationally, the failure to provide certain data or the inaccuracy of certain data may lead to a decision to refuse boarding or entry into a foreign territory, without the Carrier being held liable.
TITLE 5 - Refunds
General
In the event of a request for a refund of a Ticket, the Ticket will be refunded only to the Ticket holder or payer. Some Tickets, sold at reduced fares, are partially or totally non-refundable. It is the responsibility of the Passenger to check the conditions applicable to the use of his/her Ticket and, if necessary, to take out appropriate insurance to cover the eventuality of having to cancel his/her trip. When the holder is other than the payer, if the Ticket is refundable, the Ticket will be refunded to the person who presents proof of payment, except in the case of special conditions related to the method of payment (prepaid, on account, credit cards). Any mention made by the holder, or at his or her request, with a view to a possible refund to a third party, is without value.
Refund at the request of the Passenger
The application fee is not refundable in the event of modification or cancellation of the Ticket at the customer's initiative, or if the Ticket is not used.
Air transport service with one of our partners
Carriage to be performed by several successive Carriers is deemed to constitute a single operation under the Convention. In such case, the liability of the Carrier is limited to the Damage occurring during the Air Carriage for which its Designator Code appears on the Flight Coupon or the Ticket corresponding to the flight. When the Carrier issues a Ticket for a carriage service provided by another Carrier or when it checks in Baggage on behalf of another Carrier, the Carrier only acts as an agent of the latter. However, with regard to Checked Baggage, the Passenger has a right of recourse against the first or last Carrier involved in his/her journey.
When Carrier is the issuer of the Ticket or the one designated first on the Ticket or on a jointly issued Ticket in the case of successive Carriage, Carrier shall be liable only for the portion of the Carriage performed by its own means.
Some of the Carrier's flights or air services may be subject to a "Code Share" agreement with other Air Carriers. In such cases, a Carrier other than the one designated on the Ticket (and with which the Passenger may have made his/her Reservation) may operate the air service concerned. In this case, the Passenger will be informed of the identity of such Carrier at the time of the Reservation or at the latest at check-in. The present conditions of the Contract of Carriage also apply to this type of carriage. However, more restrictive terms and conditions may apply to flights operated by airlines other than CAIRE, including baggage allowance and animal handling.

TITLE 6 - Booking conditions and payment
Reservations are not confirmed until they are accepted and recorded by the Airline or its authorized agent in the Carrier's reservation system. Upon request, the Carrier will provide a reservation confirmation.
Passenger acknowledges that personal information about Passenger has been provided for the purpose of making a reservation, purchasing a Ticket, obtaining ancillary services, providing miscellaneous services, facilitating immigration and entry requirements, and that such information may be disclosed to governmental authorities, solely for the purpose of travel, and subject to applicable law.
For this purpose, the passenger may authorize the Carrier to keep such information, and to transmit it to its own agencies, its Authorized Agents, government authorities, the
Carriers, and the service providers mentioned above, regardless of the State. Passengers may obtain information about themselves. He/she has the right to access and rectify it.
TITLE 7 - Reservation methods and payment
RESERVATION AND PAYMENT WITH OUR CALL CENTER The Company's call center can be reached in the French West Indies at 0890 648 648 (cost of a local call). In this case, the application of service charges to the Reservation applies at the price of 5€ per passenger and per Sense at the time of issue.
RESERVATION AND PAYMENT AT OUR AIRPORT SALES POINTS The airport sales points are the agencies in Pointe à Pitre, Fort de France, St Martin Grand Case, St Barthelemy... MATOURY.... In this case, a service charge of 5€ per passenger and per direction will be applied to the ticket at the time of issue.
RESERVATION AND PAYMENT ON OUR WEBSITE Reservation is possible up to 9 passengers per file, adults and children, each adult being able to be accompanied by a baby (child of less than 2 years) travelling on his lap. In addition, a confirmation e-mail containing all the elements of your reservation will be sent to you. There are no additional service charges for purchasing Tickets via our website with secure online payment.
ONLINE PAYMENT This is done by credit card. The Company then proceeds in real time to the debit of the card. The payment is entirely secure thanks to the encryption of the data according to the highest standard. Within the framework of the fight against the fraud, only the bank cards emitted by the Banks of the following countries are accepted for the payment on the Internet site of Air Antilles: Metropolitan France, Guadeloupe, French Guyana, Martinique.
TITLE 8 - Check-in / Boarding
Check-in Deadlines (CDT) vary from one airport to another and within the same airport depending on the destination. Passengers are required to check in beforehand and to respect these times in order to facilitate their travel, failing which Reservations will be cancelled. The Company or our Authorized Agents will provide you with all the necessary information on the HLE of your first flight on our routes. If your trip includes subsequent routes, you should inquire about the HLEs, which can be found in the Schedule or obtained from us or our Authorized Agents.
The Passenger must arrive at the boarding gate at the latest at the time indicated at check-in. If the Passenger does not arrive at the boarding gate at the time indicated, the Company may cancel the Reservation, refuse to allow the Passenger to board the aircraft and, if applicable, cancel the return portion of the said ticket. The Company shall not be liable for any loss, damage or expense incurred as a result of your failure to comply with the terms of this article.
If the Passenger does not arrive in time at the check-in counter or at the boarding gate or if the Passenger does not have the appropriate travel documents and is therefore unable to travel, the Company may cancel the Reservation and dispose of the seat, without any liability towards the Passenger.
TITLE 9 - Flight schedules - delays - cancellation
General
The Company agrees to use its best efforts to transport the Passenger and Baggage with reasonable dispatch. The times indicated on the schedules or elsewhere are not guaranteed and are not part of this contract. (For this reason, we strongly recommend that you leave your telephone number at the departure and destination points in order to inform you of any changes in time).
The Company may, without notice, substitute other Carriers, use other aircraft, and may change or cancel the stopovers specified in the Ticket if necessary. Schedules are subject to change without notice. The Company assumes no responsibility for connections.
Cancellation, rerouting, delays
The Carrier shall endeavour to take all necessary measures to carry the Passenger and his/her Baggage without delay. In this context, and in order to avoid the cancellation of the carriage, the Carrier may offer the Passenger to travel on another aircraft or to make the journey on the flights of another Carrier and/or by any other means of transport.
(2) Except as otherwise provided in the Convention, and where the Passenger has a single Contract of Carriage (as defined in the said Convention) which is the subject of a Reservation :
- If the Carrier cancels a flight,
- If it is performed in excess of the scheduled time,
- If it causes the Passenger to miss a connecting flight, or- if the flight does not stop at the voluntary stopover point or destination,
- If the Passenger is denied boarding due to overbooking.
The Carrier shall, in agreement with the Passenger: (a) Carry the Passenger on the next flight where a seat is available, at no additional cost and, if applicable, extend the validity of the Ticket accordingly, or (b) Re-routing the Passenger to the destination indicated on the Ticket within a reasonable time, in whole or in part on the Carrier's own flights or those of another Carrier, or by any other means of transport agreed upon with the Passenger. In the cases referred to in paragraph 2 of this article and unless otherwise provided for by the Convention or by the Community law in force, the choices proposed in sub-paragraph (b) are the only ones that the Carrier is obliged to offer to the Passenger. (3) Compensation for denied boarding in case of overbooking. If, due to a scheduled overbooking, the Carrier is unable to allocate a seat to the Passenger, even though the Passenger has a confirmed Reservation, a valid Ticket and has checked in within the required time and conditions, the Carrier shall grant the compensation provided for by the law in force.
TITLE 10 - Pricing conditions
Fees, taxes and royalties
Any fees, taxes or charges imposed by any government or other authority or by the operator of an airport shall be borne by the Passenger. At the time of Ticket purchase, Passengers will be advised of such fees, taxes or charges, which are in addition to the Fares and, in most cases, appear separately on the Ticket. Such fees, taxes and charges may be created or increased after the date of Ticket purchase if there is more than four months between the contract and the provision of services. In such case, the Passenger will be required to pay the corresponding amount. Conversely, if any fees, taxes or charges are reduced or waived, the Passenger may be reimbursed for the amounts reduced or waived.
Surcharge fees
Fares are quoted inclusive of all taxes including fuel surcharge. Airline companies are subject to the vagaries of taxation whose calculation rules are specific to each country. Taxes and surcharges may be modified without prior notice and will be applied according to the applicable rate of the day (rate applicable on the day of the reservation / modification / cancellation).
Prices
General
Fares apply only to transportation from the originating airport to the destination airport, unless otherwise specified. Fares do not include surface transportation between airports and between airports and city terminals. Fares will be calculated in accordance with the Fares in effect on the date of purchase of the Ticket, for travel on the dates and for the itinerary shown on the Ticket. Any change in itinerary or travel date may affect the applicable Fare. The applicable Fares are those published by Carrier or calculated by Carrier in accordance with the fare regulations in effect for the flight or flights shown on the Ticket from the point of departure to the point of destination, for a given class of transportation, on the date of purchase of the Ticket. If otherwise provided in the Contract of Carriage or in any other contractual document, the Fares shall apply exclusively to the trip specified in such Contract or document.
Promotional fares are subject to special conditions that may impose usage restrictions, surcharges, or prohibit rebooking and may prohibit or limit the amount of a refund in the event of cancellation or no-show. Prices are quoted inclusive of all taxes, except for certain locally imposed airport taxes.

Seats, services on board
On our flights, the Company does not assign seats and does not allow the passenger to choose his or her seat. In the case of code-share flights, seats may be assigned by the carrier operating the flight. This information will be communicated to you at the time of booking. On our flights, only hot or cold beverages may be served on board. These beverages may vary from one stopover to another depending on availability and are not subject to any refund or claim. In the case of codeshare flights, meals may be served by the carrier operating the flight. This information will be communicated to you at the time of booking.
Travel conditions for special cases
Special assistance
Acceptance for carriage of unaccompanied children, passengers with reduced mobility, pregnant women, sick persons or any other person requiring special assistance is subject to the prior agreement of the carrier. Carrier reserves the right to cancel the passenger's reservation without refunding the fare. The passenger will be denied boarding at his/her own expense.
Pregnant women
Pregnant women can travel by plane until the seventh month of pregnancy, unless medically contraindicated. - From the first day of the eighth month, by providing a medical certificate of good health without contraindication to travel, established by the attending physician within 4 days of the date of travel and specifying in which month of pregnancy the client is at the time of the flight. The procedure is the same for the return flight in the case of a stay of more than 15 days. - They cannot travel on our lines during their last month of pregnancy. They are not allowed to travel as an emergency exit.
Children under 2 years old
Children under 2 years of age do not have a seat and must travel on the lap of an autonomous, valid and responsible adult over 18 years of age. An adult cannot accompany more than one child under 2 years old. For safety reasons in case of turbulence, during landing and takeoff, the baby must be attached with a baby belt (provided by the crew) to one of the parents and be kept on the parent's lap. The Company does not provide drinks or hygiene kits for the baby. Reservations for children under two years of age are not authorized on the website www.airantilles.com or www. airguyane.com as they are subject to a quota and must be specifically accepted by the Company.
Unaccompanied children UM
UMs are accepted on board from 5 to 12 years of age. The number of UMs on board is limited on each flight and must be approved in advance by the Company. When making a reservation, it is mandatory to communicate the name and contact details of the accompanying person on departure and arrival of the flight. If the person accompanying the child on arrival does not show up or cannot be reached, the child will be sent back on the next flight to his/her point of origin. Reservations for a child traveling alone are not permitted on www.airantilles.com as they are subject to a quota and must be specifically accepted by the airline.
People with disabilities and reduced mobility
A PRM is any person whose mobility is reduced, when using a means of transport, due to any physical disability (sensory or motor, permanent or temporary) or any intellectual disability or impairment or any other cause of disability, or age, and whose situation requires appropriate attention and adaptation to his or her particular needs of the service made available to all passengers. (Art. 2 of European Regulation 1107/2006 of July 5, 2006) Disabled persons or persons with reduced mobility must contact the Carrier prior to any reservation and obtain prior approval from the Carrier, failing which they may be denied boarding. An accompanying person may be necessary when the person is not autonomous. By "accompanying person" we mean any person accompanying the PRM during transportation. This person must be an adult, civilly responsible, not responsible for a child under 12 years of age during the planned trip, and capable of providing for the needs of the PRM in his or her care and of evacuating him or her, if necessary, when the PRM is not self-sufficient.
People with special needs
Persons (adults or children) with behavioral problems must be accompanied. Their transportation will be subject to the Carrier's agreement. To this end, the PRM must provide a medical certificate attesting that he/she does not represent any danger to the safety of the flight, himself/herself, other passengers and the crew. In certain cases, a request for admission on board must be submitted to the Company no later than forty-eight hours (48h) before the published departure time of the flight in question. In any case, the decision whether or not to take the passenger on board (accompanied or not) remains with the captain on the day of departure. An accompanying person may be necessary when the person is not autonomous. An "accompanying person" is defined as any person who accompanies a person with special needs during transportation. This person must be an adult, civilly responsible, not responsible for a child under 12 years of age during the planned trip, and capable of providing for the needs of the person in his or her care and of evacuating him or her, if necessary, when the person is not autonomous.
TITLE 11- Luggage
Checked Baggage will be returned to the bearer of the Baggage Check. In the event of Damage to Baggage during international air transportation, any claim must be made in writing to the Carrier immediately after discovery of the Damage or, at the latest, within seven days from the date of receipt thereof; in the event of delay, the claim must be made within twenty-one days from the date of delivery of the Baggage.
Luggage allowance
COOL, FLEX and SUPER fares entitle the passenger to free transportation of one piece of baggage weighing up to 23 kg without having to pay a supplement. This allowance is indicated on the ticket. The cabin baggage allowance is 5 kg. The dimensions of the cabin baggage must respect the size of 115cms (height + width + depth). Passengers may travel with Checked Baggage in excess of the Baggage Allowance, subject to payment of a fee. The conditions relating to this additional fee are available from the Carrier, its Authorized Agents and on the Company's Website. In any event, Checked Baggage may not exceed a maximum weight per Passenger. Information concerning this maximum weight is available from the Carrier, its Authorized Agents and on the Company's Website. The Passenger may obtain all useful information concerning this Baggage Allowance from the Carrier, its Authorised Agents and on the Company's Website.
Excess luggage
Checked Baggage accepted for carriage in the hold must not exceed certain weight and size limits, which will result in the payment of an additional fee above a certain allowance. The conditions for payment of excess Baggage are available upon request at the Carrier's sales outlets and its Authorized Agents and on the Company's website.
Special Declaration of Interest
For any Checked Baggage the value of which exceeds the limits of liability in case of destruction, loss, damage or delay, as defined by the Convention, Passengers may either personally insure all their Baggage before the journey, or make, at the time of delivery of the Baggage to the Carrier, a Special Declaration of Interest limited to a certain amount. In the latter case, an additional sum, communicated on request, must be paid by the Passenger. Compensation shall be paid in accordance with the provisions of Article XV. The Carrier reserves the right to verify the adequacy of the declared value with the value of the Baggage and its contents. The Carrier may refuse any Special Declaration of Interest if the Passenger does not comply with the time limit set by the Carrier for making such declaration. The Carrier also has the right to limit the level of declarations that may be made to a maximum amount.
Animals
It is your responsibility to inform yourself of the phytosanitary conditions of acceptance of the destination and/or transit countries. - The animal must be over 4 months old. - Tattooing for domestic carnivores is mandatory for all destinations (or identification by microchip, according to the decree of 02/07/01 with implementation on 03/12/01). - All vaccinations must be up to date and effective, vaccination against rabies is mandatory at the departure and destination of all our ports of call except Martinique, Guadeloupe and Reunion Island (decree of January 14, 2008-JO) - The health record must be up to date and presented at check-in. - The customer must present a certificate of good health, established by the veterinary services and dating less than 5 days at the date of travel. This certificate must also be issued by the veterinary services of the destination if the customer's stay exceeds 15 days. - The transport can be done in the cabin if the weight of the animal plus its container does not exceed 5 kg. The container must be approved for air transport. The animal must be kept in its container during the entire flight, and will remain under the exclusive responsibility of the passenger. Transportation is free of charge if it is included in the customer's cabin allowance. Otherwise, the animal must travel in the hold. - The animal is transported in the hold if the weight of the animal and its container does not exceed a certain weight (see Baggage allowance). The animal and its container are then an integral part of the passenger's baggage allowance and are subject to the same rules as baggage. - Above this weight, the animal must be transported as cargo. - The Passenger may obtain all useful information concerning this Baggage Allowance from the Carrier, its Authorized Agents and on the Company's Website. - Dogs of the first and second categories, as defined by the French law of January 6, 1999, and articles 1 and 2 of April 21, 1999 published in the Official Gazette on April 30, 1999, are not allowed to travel on our flights.
TITLE 12 - Right to refuse transportation
The Company may decide to refuse to carry you or your Baggage if one or more of the following conditions exist or are, in our opinion, reasonably likely to exist This measure is necessary to comply with the legislation in force, if the regulations or instructions of a state, the country of departure, destination, transit or overflight require it, the physical or mental state of the Passenger, presents a danger or even a risk to the Passage itself or to the other Passengers, the crew or the property, the Passenger is drunk or under the influence of alcohol or drugs, the Passenger has not complied with the instructions of the Company or has refused to have his/her Baggage or him/herself subjected to security checks, or the Passenger has not paid the fare (including surcharges, taxes, duties or related fees) for his/her trip, or the Passenger does not have his/her travel documents, or it does not appear that he/she is not in possession of valid travel documents, or the Passenger attempts to enter a country for which your travel documents are not valid. The Passenger has not presented a valid Ticket. Or the Passenger has presented a fraudulently acquired Ticket. Acceptance for carriage of unaccompanied children, Passengers with Reduced Mobility, pregnant women and sick persons or any other person requiring special assistance is subject to our prior approval. The Company reserves the right to cancel the Passenger's Reservation without having to refund the fare. The Passenger will be denied boarding at his/her expense. If the Passenger has a medical history, he/she is recommended to consult a doctor before boarding a flight, and to take all necessary precautions.
TITLE 13 - Administrative formalities
The Passenger is responsible for complying with governmental travel requirements, for presenting any required exit, entry or other documents and for arriving at the airport at the time specified by the Carrier or, if no time has been specified, in sufficient time before departure to allow the completion of departure formalities. It is the Passenger's responsibility to check entry and residence formalities with the embassy and consulate of your destination or connecting country.
TITLE 14 - Prohibited items / hazardous substances
For the safety of Passengers, certain items are strictly prohibited on board. In such cases, they will be confiscated during the baggage check.
- Bladed weapons and any sharp, blunt, metallic or non-metallic object that can be used as a weapon (examples: nail scissors, razor blade...).
- Firearms.
- Cartridges and ammunition for hunting or sporting weapons.
- Perfumes and aerosols.
- Lighter fuels.
- Batteries with electrolyte.
- Fireworks, firecrackers, fireworks, flares, dummy guns, fire starters, tear gas.
- Camping stoves, gas bottles, diving bottles.
- Paint, varnish, lacquer.
- Toxic, infectious and radioactive materials.
- Chemical products, fertilizers, weed killers, pesticides, insecticides.
- Les décapants, eau de Javel, chlore, lessive.
- Flammable liquids such as fuel, thinner, solvent, acetone.
- Mercury thermometers and barometers.
- Animal products: the transport of wild animal meat in any form by air (cabin, hold or cargo) is strictly prohibited to the European Union. Passengers violating this ban are subject to criminal sanctions.
Governmental or state measures may change this list at any time. The Company will inform the Passenger as soon as it becomes aware of such changes. The Company is not responsible for any such changes that may occur.
TITLE 15 - Responsibility of the Air Carrier towards the passengers and their luggage
The rules described below are based on the Montreal Convention of 28 May 1999, implemented in the Community by Regulation (EC) No 2027/97 as amended by Regulation (EC) No 889/2002 and by the national legislation of the Member States. Compensation in case of death or injury. There is no financial limit to liability for injury or death of a Passenger. For any damage up to 113 SDRs (approximately 120 Euros), the air carrier cannot contest claims for compensation. Above that amount, the air carrier may defend itself against a claim by proving that it was not negligent or otherwise at fault. Advance payments. In the event of the death or injury of a passenger, the air carrier shall make an advance payment to cover immediate economic needs within fifteen days of the identification of the person entitled to compensation. In the event of death, this advance payment may not be less than 16,000 SDRs (approximately 17 Euros). The payment of an advance does not constitute an admission of liability, and the advance may be offset against any subsequent sums paid in respect of the liability of the Community air carrier; it is not refundable, except in the cases referred to in Article 20 of the Montreal Convention, or where the person to whom the advance has been paid was not entitled to compensation. Liability of contracting and operating carriers. If the air carrier operating the flight is not the same as the contracting carrier, the passenger has the right to make a complaint or claim against either of them. If the name or code of an air carrier appears on the ticket, that carrier is the one with which a contract has been concluded.
Delay of passengers
The Carrier shall not be liable for Damage resulting from delay if it proves that it, its servants or agents took all measures that could reasonably be required to avoid the Damage or that it was impossible for it to take such measures. The Carrier shall not be liable for Damage resulting from delay if such delay is attributable to the Passenger or if the Carrier has contributed thereto, i.e. if the Damage results in whole or in part from the negligence, act or omission of the person claiming compensation or of the person from whom he/she derives his/her rights. In case of delay of the Passengers, the Air Carrier is liable for the Damage, unless it took all reasonable measures to avoid it or if it was impossible to take such measures. The liability for Passenger delay is limited to 4,694 SDRs.
Luggage Carrier's liability shall be limited to damage to Checked Baggage in accordance with international conventions and applicable law. If the total weight of the Baggage is not mentioned on the Baggage Check, the total weight of the Checked Baggage shall be presumed not to exceed the maximum number of kilograms allowed. The Carrier shall not assume any liability for Damage to Hand Baggage, unless such Damage results from the fault of the Carrier. In the event that a fault of the Passenger has contributed to the Damage, the liability of the Carrier shall be assessed on the basis of the applicable legislation. The Carrier shall not be liable for Damage caused by the failure of the Passenger to comply with the applicable legal or regulatory provisions or the Carrier's instructions. The Carrier shall not be liable for Passengers' injuries or Damage caused to their Baggage when caused by objects contained in such Baggage. Any Passenger whose personal object injures another person or causes Damage to the property of such person or of the Carrier shall be liable and liable for compensation, including for any loss and expenses incurred by the Carrier as a result thereof. The Carrier shall not be liable for Damage due to theft or late delivery or loss of fragile or perishable items, currency, jewelry, precious metals, silverware, valuables, securities, passports or other identification documents contained in the Baggage, whether checked or hand baggage. Destruction, loss or damage of baggage: The Airline is liable for destruction, loss or damage of baggage up to 1113DTS (approximately 1 Euro). In the case of checked baggage, it is liable even if it is not at fault, unless the baggage was defective. In the case of unchecked baggage, the Carrier is liable only if it is at fault. Higher liability limit for baggage: A passenger may benefit from a higher liability limit by making a special declaration at or before check-in and paying an additional fee. Baggage delay: In case of baggage delay, the Air Carrier is liable for damages, unless it has taken all reasonable measures to avoid them or it was impossible to take such measures. TITLE 16 - Time limits for protests and liability actions :
General principles
Notification of protests for Baggage (1) The receipt of Checked Baggage without protest within the time limit set by the addressee shall constitute a presumption, unless the Passenger proves otherwise, that the Baggage has been delivered in good condition and in accordance with the Contract of Carriage. Any missing Baggage must be reported to the Carrier as soon as the flight arrives. Any declaration made afterwards may not be taken into account. Likewise, any item found missing from the Baggage must be reported to the Carrier as soon as possible. Any late declaration may not be taken into consideration. (2) In the event of damage, delay, loss or destruction of the Baggage, the Passenger concerned must complain in writing to the Carrier as soon as possible and at the latest within seven (7) days (in the event of damage or destruction) and twenty-one (21) days (in the event of delay) respectively from the date on which the Baggage was placed at his/her disposal. (3) In the absence of protest within the time limits provided, all actions against the Carrier shall be inadmissible, except in the case of fraud on the part of the Carrier. (4) If the protest has been made within the prescribed time limits (seven (7) or twenty-one (21) days) and no conciliation has been reached between the Carrier and the Passenger, the Passenger may bring an action for damages within two years following the date of arrival of the aircraft, or following the date on which the aircraft was to have landed. b) Liability action for Passengers/ Time limit Any liability action must be brought, under penalty of forfeiture, within two years from the date of arrival at destination, or from the date on which the aircraft was scheduled to arrive or from the cessation of carriage. The method of calculating the time limit shall be determined by the law of the court seized of the case. c) All claims or actions referred to in paragraphs a) and b) above must be made in writing within the time limits indicated.
